Ola Electric is now facing a third insolvency petition from Seoyon E-Hwa Summit Mobility, amid ongoing disputes with multiple suppliers over unpaid dues.

Days after it emerged that Sterling E-Mobility Solutions and Anevolve Mando eMobility had initiated insolvency proceedings against Ola Electric, the listed electric vehicle (EV) maker is now reportedly facing a third such case. This development highlights the ongoing financial challenges faced by the company in a rapidly evolving and competitive market.

According to reports, the Bengaluru bench of the National Company Law Tribunal (NCLT) has issued a notice against Ola Electric in connection with an insolvency plea filed by vendor Seoyon E-Hwa Summit Mobility Krishnagiri Pvt. Ltd. The vendor has reportedly sued the listed company over an alleged default on payment totaling ₹9.57 Crores. This legal action underscores the precarious financial situation that Ola Electric finds itself in as it grapples with multiple insolvency claims.

During the tribunal proceedings, advocate Dhyan Chinnappa, representing Seoyon E-Hwa Summit Mobility Krishnagiri, stated that the vendor supplied automobile parts to Ola Electric. The vendor further claimed that the EV maker owed a total of ₹21.19 Crores when the demand notice was issued on April 2. However, after receiving the notice, Ola Electric disputed the liability, citing warranty and supply issues related to spare parts. This dispute has now escalated to legal proceedings, illustrating the complexities involved in supplier relationships within the automotive sector.

Despite the ongoing disputes, Seoyon E-Hwa Summit Mobility later acknowledged that Ola Electric paid ₹10.62 Crores, leaving an outstanding balance of ₹9.57 Crores. Following the submissions, the NCLT issued directions to send a notice to Ola Electric, contingent upon the vendor providing the originally signed extract of the board resolution and identity documents of the signatory to the petition. The tribunal has scheduled the next hearing for August 31, indicating that the legal proceedings will continue to unfold in the coming weeks.

This latest insolvency petition comes just days after it was revealed that Ola Electric was facing similar petitions from two other suppliers, Anevolve Mando E-Mobility Pvt Ltd and Sterling E-Mobility Solutions Pvt Ltd, over alleged unpaid dues. In response to these claims, the Bhavish Aggarwal-led company issued a clarification, asserting that the disputes were pre-existing and already under arbitration. Ola Electric pointed out that it had raised concerns regarding warranty and performance issues related to parts supplied by these vendors, indicating a broader pattern of operational challenges.

In light of these developments, Ola Electric has initiated arbitration proceedings and has also moved the Commercial Court in Bengaluru under the Arbitration and Conciliation Act, 1996, seeking interim relief until arbitral tribunals are constituted. This move highlights the company's attempt to navigate the legal landscape while addressing its financial obligations to suppliers. It also reflects the complexities of business relationships in the EV sector, where rapid innovation and supply chain dynamics can lead to disputes over product quality and payment terms.

This is not the first time that Ola Electric has faced insolvency proceedings. In March of the previous year, registration service provider Rosmerta Group filed an insolvency petition against the company. However, the two parties later reached a settlement, resulting in the withdrawal of the insolvency petition. This history of legal challenges suggests that Ola Electric is not only dealing with current financial pressures but also a legacy of unresolved disputes that could impact its reputation and operational stability.

The petitions against Ola Electric come at a critical time as the company is attempting to chart an operational turnaround following a challenging couple of years. The past year has seen the OEM's sales and market share plummet, while losses have remained elevated amid rising customer complaints. The competitive landscape for electric vehicles is intensifying, with numerous players entering the market, making it imperative for Ola Electric to address its operational inefficiencies and regain consumer trust.

Financially, Ola Electric managed to narrow its net loss by 43% year-over-year to ₹500 Crores in Q4 FY26, while revenue fell by 57% year-over-year to ₹265 Crores due to reduced deliveries. This indicates that while the company is making strides in reducing losses, it still faces significant revenue challenges that need to be addressed to ensure long-term sustainability. The decline in revenue and market performance raises questions about the company's ability to compete effectively in a sector that is rapidly evolving.

Looking ahead, Ola Electric has set ambitious goals, aiming to regain a market share of 15% to 20% within the ongoing calendar year. The company plans to expand its electric motorcycle business and increase the capacity of its gigafactory to 6 GWh in Q1 FY27. These strategic initiatives reflect the company's commitment to growth and innovation in the electric vehicle market, but they also come with inherent risks, especially given the current financial pressures.

Additionally, the company undertook a qualified institutional placement (QIP) last month, raising ₹780.24 Crores. This capital infusion is crucial for financing its expansion plans and addressing its operational challenges. However, the efficacy of this funding will depend on how well the company can execute its strategies and manage its supplier relationships moving forward.

In conclusion, the ongoing insolvency petitions against Ola Electric reveal a critical juncture for the company as it navigates financial difficulties and operational disputes. The outcome of the legal proceedings will likely have significant implications for its future, influencing its ability to regain market share, restore supplier relationships, and ultimately achieve its growth objectives in the highly competitive electric vehicle landscape. As the situation develops, stakeholders will be closely monitoring Ola Electric's responses and strategic decisions in the coming months.
