Maharashtra FDA Withdraws Cipla Licence Cancellation After Court Intervention

The Maharashtra FDA has revoked its cancellation of Cipla's drug sale licence following a Bombay High Court ruling that criticized the regulator's procedures.

The Maharashtra Food and Drug Administration (FDA) has retracted its order that cancelled the drug sale licence of Cipla Pharma & Life Sciences Ltd's Carry and Forwarding (C&F) facility in Pune. This decision comes after the Bombay High Court reprimanded the FDA for its high-handed approach and procedural errors.

The FDA informed the court that it would immediately withdraw the licence cancellation order and issue a new show-cause notice to Cipla. Following this, a reasoned order will be provided to the company. This development underscores the ongoing tensions between regulatory authorities and pharmaceutical companies, particularly regarding compliance with procedural norms and the principles of natural justice.

A bench comprising Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad noted that the FDA had not adhered to proper procedures and had violated principles of natural justice. The concept of natural justice is a fundamental principle in administrative law that ensures fairness in legal proceedings. It typically includes the right to be heard and the right to an unbiased decision-maker. In this case, the court's intervention emphasizes the critical role of these principles in regulatory actions.

This legal challenge arose after the FDA cancelled the drug sale licences for Cipla's C&F facility at Wadki in Pune, effective August 27. Senior counsel Aabad Ponda, representing Cipla, argued that the FDA had instructed the company via email to attend a hearing on August 26, which was a public holiday declared by the state government. The scheduling of a hearing on a public holiday raises questions about the FDA's procedural fairness and its understanding of reasonable notice requirements for companies it regulates.

Ponda stated that Cipla had requested an adjournment due to the unavailability of a representative on the holiday. However, the FDA proceeded to issue the cancellation order on the same day without allowing the company to present its case. This lack of opportunity for Cipla to defend itself against the allegations has been a focal point of the court's criticism of the FDA's actions.

In response, Additional government pleader P P Kakade, representing the FDA, contended that the law did not grant the company a right to a hearing. The bench challenged the FDA's rationale for scheduling a hearing on a public holiday and subsequently issuing a cancellation order without providing an opportunity for Cipla to be heard. The court remarked, "You are doing a laudable and appreciative job but now you are going overboard. This is not the first time this is happening. You have wronged and now you have to resolve the issue." This statement reflects the court's concern over the FDA's approach and its implications for the regulatory landscape in India.

The FDA's initial cancellation of the licences was based on alleged irregularities related to the packaging, storage, and recall of Reactin Plus Tablets. Inspections conducted by the regulator reportedly uncovered unauthorized promotional text on the packaging of the Schedule H prescription medicine, discrepancies between physical and computerized stock records, gaps in purchase and sale records, and non-compliance with recall directives. These allegations highlight the importance of strict adherence to regulatory standards in the pharmaceutical industry, where public health and safety are paramount.

Despite these allegations, Cipla clarified that the FDA's order did not raise any concerns regarding the safety, quality, or efficacy of its products, nor did it indicate any issues related to patient safety. This distinction is crucial, as it suggests that while there may have been procedural or administrative lapses, the core integrity of Cipla's products remained intact. Such clarifications can have significant implications for the company's reputation and operational continuity, especially in a highly competitive and scrutinized market like pharmaceuticals.

The Maharashtra FDA's retraction of the licence cancellation highlights the importance of adhering to due process and ensuring that companies are afforded fair opportunities to respond to regulatory actions.
