The State Legal Services Authority has initiated a 40-hour mediation training program to enhance the skills of judicial officers and legal professionals in Itanagar.

ITANAGAR, 20 Jul: The State Legal Services Authority (APSLSA) on Monday launched a 40-hour mediation training programme under the aegis of the Mediation and Conciliation Project Committee (MCPC) of the Supreme Court of India. This initiative is part of a broader effort to enhance the capacity of legal professionals and judicial officers in the region, focusing on alternative dispute resolution (ADR) mechanisms, which have gained prominence as effective tools for resolving conflicts outside of traditional court settings.

The six-day training programme is aimed at strengthening the capacity of judicial officers and legal professionals in the field of mediation, and promoting alternative dispute resolution mechanisms. Mediation, as a form of ADR, offers a platform for disputing parties to engage in dialogue facilitated by a neutral third party, with the goal of reaching a mutually acceptable resolution. This approach not only alleviates the burden on the judicial system but also empowers individuals to take control of their disputes in a more collaborative environment.

The inaugural session was attended by Gauhati High Court judges Justice Kardak Ete and Justice Budi Habung, and APSLSA Member Secretary Tadu Tamang, along with legal professionals from across the state. The presence of such esteemed legal figures underscores the importance of the training programme and reflects a concerted effort to enhance the legal framework surrounding mediation in the region.

Tamang in his address reiterated the APSLSA’s commitment to promoting alternative dispute resolution mechanisms. He stated that the intensive 40-hour training programme aims to equip participants with the knowledge, ethics, communication techniques, and practical skills required to conduct mediation proceedings efficiently and effectively. This comprehensive approach is essential, as the success of mediation often hinges on the mediator's ability to navigate complex interpersonal dynamics and facilitate constructive dialogue.

Justice Habung underscored the significance of developing a robust pool of trained mediators to ensure effective implementation of mediation as envisaged under the legal framework. He encouraged the participants to actively engage in the training and acquire the practical skills necessary for facilitating successful mediation. The development of skilled mediators is crucial, as they play a pivotal role in guiding parties through the mediation process and ensuring that discussions remain focused and productive.

Justice Ete emphasised the growing importance of mediation as an effective, accessible, and people-centric mechanism for resolving disputes. He highlighted that mediation not only reduces the burden on courts but also fosters harmony by enabling parties to arrive at mutually acceptable solutions. The emphasis on accessibility is particularly relevant in the context of diverse communities, where traditional legal processes may be perceived as intimidating or inaccessible.

The training programme will continue over the next four days, covering various aspects of mediation, including communication skills, negotiation techniques, ethics, confidentiality, and practical mediation procedures under the guidance of Pusshp Gupta, VP Thankachan, and Neena Khare, senior trainers from the MCPC. Each of these components is vital for developing a well-rounded understanding of mediation practices and ensuring that participants are well-prepared to handle a variety of conflict scenarios.

Alternative dispute resolution mechanisms, particularly mediation, have been recognized globally for their effectiveness in resolving disputes in a timely and cost-effective manner. In India, the legal framework surrounding mediation has evolved significantly, with the Supreme Court of India advocating for its increased use to alleviate the backlog of cases in courts. The introduction of training programmes such as this one is a proactive step towards embedding mediation within the legal culture of the country.

In recent years, the Indian judiciary has made strides in promoting mediation as a preferred method for dispute resolution. The establishment of the Mediation and Conciliation Project Committee (MCPC) by the Supreme Court in 2005 was a landmark moment that aimed to create a structured approach to mediation in India. The MCPC has been instrumental in developing training modules, guidelines, and best practices for mediators across the country.

Furthermore, the integration of mediation into the legal system aligns with global trends, as many jurisdictions around the world increasingly recognize the benefits of resolving disputes through mediation rather than litigation. Mediation fosters a collaborative atmosphere, encourages open communication, and often results in solutions that are more satisfactory to all parties involved compared to those imposed by a court.

The implications of enhancing mediation training are far-reaching. As more legal professionals become adept at mediation, the overall efficiency of the legal system can improve. This not only benefits the individuals involved in disputes but also helps to alleviate the pressure on courts, which are often overwhelmed by a high volume of cases. By fostering a culture of mediation, the legal system can become more responsive to the needs of the community, ultimately leading to a more harmonious society.

In conclusion, the launch of the 40-hour mediation training programme by the APSLSA marks a significant step towards promoting alternative dispute resolution in the region. By equipping legal professionals and judicial officers with the necessary skills and knowledge, this initiative aims to enhance the practice of mediation, ultimately contributing to a more efficient and accessible legal system. As the programme unfolds over the coming days, it is expected that participants will gain valuable insights and practical skills that will benefit not only their professional development but also the communities they serve.
